HERE ARE A FEW FACTS YOU SHOULD KNOW
ABOUT AUDIO AND VIDEO SURVEILLANCE
1.– According to the Canadian Federal Charter of Rights ch. P21 (Privacy Act), there is
no difference between Video and Audio surveillance. The same rules and guidelines
apply to both types of surveillances, meaning that the information gathered (recordings)
must respect and comply with the Privacy Act regulations. These regulations clearly
stipulate what is unacceptable.
2.- In Canada, all provinces with the exceptions of Alberta, British Columbia and Quebec
are under the jurisdiction or governed by the Federal Charter of Rights (Privacy Act).
These three provinces have their own regulations or Civil Codes, but their rules are
based upon or linked to the Federal Privacy Act. Ex.: Quebec’s Civil Code ch. 35-36 as
well as CAIQ (Commission de l’Accès à l’information du Québec) rule 2.1.2.3
3.- It is important to understand that Audio and Video surveillances, are the ultimate tools
used for public security (protection) and can be most effective in reducing and solving
crimes. The information gathered (recordings), are helpful when a crime has been
committed.
4.- You need not have the public’s authorisation to install Audio or Video surveillance
systems. However, the public should be advised (informed) with appropriate signs
(decal notices), installed in visible locations and stating the type of surveillance on the
premises.
5.- Sound does make all the difference. Such as a fingerprint or DNA, Audio is distinct and
most helpful in solving crimes. When an image or picture is not clear or recognizable, the
Audio will assist law enforcement in identifying the criminal(s) and can be introduced in a
Court of Law.
UNITED STATES REGULATIONS
To comply with the legality of Audio and Video surveillance as pertains to the United States Code, Title 18, section 2510(2), once again, visible signs must be installed to inform the public. The laws vary from state to state, therefore, you must verify with the appropriate state agency.
